1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Practice" means Tegak Advocate, Suite 12-3, Block C, Presint 4, 62100 Putrajaya.
- "Services" means the legal services offered by the Practice: plain-language will drafting, standard probate filing, and power of attorney and living document set preparation.
- "Client" means any individual or entity that engages the Practice to provide Services.
- "Website" means this website and all pages contained within it.
- "Agreement" means the terms and conditions set out in this document, together with any engagement letter or fee agreement entered into between the Practice and a Client.
2. Acceptance of Terms
By using this website or engaging the Practice for legal services, you agree to be bound by these Terms and Conditions. If you do not agree, you should not use this website or engage the Practice.
The Services are intended for individuals aged 18 years and over. By engaging the Practice, you confirm that you have the legal capacity to enter into a binding agreement under the laws of Malaysia.
3. Service Description
Tegak Advocate provides the following legal services in Malaysia:
- Plain-language will drafting (RM 700)
- Standard probate filing (RM 1,200)
- Power of attorney and living document set preparation (RM 1,600)
Services are available to clients in Malaysia. The Practice does not represent clients in contested probate proceedings or criminal matters. Where a matter falls outside the scope of the above services, the Practice will advise the Client accordingly before any work begins.
4. User Responsibilities
Clients agree to:
- Provide accurate and complete information as required for the Services
- Respond to requests for instructions or documentation within a reasonable timeframe
- Notify the Practice promptly of any change in circumstances relevant to the Services
- Not use the website for any unlawful purpose
5. Intellectual Property
All content on this website — including text, design, and structure — is the property of Tegak Advocate. You may not reproduce, redistribute, or use it for commercial purposes without prior written permission. Documents prepared for a Client in the course of an engagement are the property of the Client upon payment of the agreed fee.
6. Payment Terms
Fees are charged in Malaysian Ringgit (RM). The fees stated on this website are the fees for each standard service as described. Payment terms are set out in the engagement letter issued at the start of each matter. Accepted payment methods will be confirmed at the time of engagement.
Where a matter falls outside the standard scope, additional fees will be discussed and agreed before additional work commences. No invoice will include charges that were not agreed in advance.
7. Service-Specific Terms
Will Drafting: The Practice will prepare a draft will based on information provided by the Client. The Client is responsible for ensuring the information provided is accurate and complete. The will takes effect only upon proper execution; the Practice will advise on the execution requirements.
Probate Filing: The Practice will prepare and file the probate application on behalf of the executor. Timelines depend on court scheduling and are outside the Practice's control. Realistic timelines will be provided at the start of the engagement but are not a commitment to a specific outcome date.
Living Document Set: The Practice will prepare a coordinated set of living documents based on the Client's instructions. The Client is responsible for reviewing each document and raising any concerns before execution. The scope and applicability of advance care directives may vary depending on individual circumstances and applicable law.
8. Disclaimers
The information on this website is for general information only and does not constitute legal advice. The Services constitute legal advice in the context of an established client-practice relationship governed by the Legal Profession Act 1976.
The Practice does not warrant any particular legal outcome. Legal proceedings and court processes involve factors outside the Practice's control. The Practice will conduct each matter with reasonable skill and care.
9. Limitation of Liability
To the extent permitted by Malaysian law, the Practice's liability to any Client in respect of any matter shall not exceed the fees paid by that Client for the relevant Service.
The Practice shall not be liable for delays caused by court processes, third-party services, or circumstances outside its reasonable control.
10. Termination
Either party may terminate an engagement by written notice. Where the Client terminates, fees for work completed to the date of termination are payable. Where the Practice terminates, the Client will be given reasonable notice and the file will be transferred as requested. Obligations of confidentiality survive termination.
11. Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
The Practice is also subject to the disciplinary jurisdiction of the Malaysian Bar Council under the Legal Profession Act 1976. Complaints about professional conduct may be directed to the Bar Council.
12. General Provisions
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force. A failure by either party to enforce any provision shall not constitute a waiver of that provision.
These Terms, together with any engagement letter, constitute the entire agreement between the Practice and the Client in respect of the relevant Services.
13. Changes to These Terms
We may update these Terms from time to time. The effective date at the top of this page will reflect any changes. Continued use of the website or engagement of Services after a change constitutes acceptance of the updated Terms.
