FAQ / COMMON ENQUIRIES

Frequently Asked Questions

What is the first step in drafting a will?

We begin with a conversation — either in person at our Putrajaya office or by telephone — to understand your circumstances and wishes. There is no paperwork at this stage. We use that conversation to explain what the will needs to cover and how we would approach the drafting.

How long does probate normally take in Malaysia?

Probate timelines in Malaysia vary depending on the complexity of the estate and the court's schedule. For straightforward applications, it is not unusual for the process to take several months to over a year. We explain realistic timelines at the very start of the engagement so there are no surprises.

What is included in a Power of Attorney and Living Document Set?

The set covers a power of attorney, a living will or advance care directive where applicable, and supporting beneficiary instructions. All three documents are drafted together so they form a coherent whole rather than a set of unrelated forms. Each is explained to you before you sign.

Are the fees fixed or subject to change?

The fees listed are the fees for each service as described. If your situation is more involved than a standard matter, we would discuss that openly with you before any work begins. There are no charges that are not explained in advance.

Do I need to visit the office in person?

An initial consultation can be conducted by telephone or at the office, depending on what is more convenient for you. Certain steps — such as the signing of a will — do require attendance in person. We will let you know clearly which steps need to be done in person and which can be handled remotely.

How are my documents kept private?

All client matters are kept in strict confidence. Documents are stored securely and are not shared with any party except those you have authorised. Our obligations are governed by the Legal Profession Act 1976 and the standards of the Malaysian Bar.
