Three Matters, How They Were Handled

CASE-001 / WILL DRAFTING

A retiree in Putrajaya, first will

THE SITUATION

The client had reached retirement age with no will in place. He had a clear sense of his wishes but had assumed a will would require complicated legal language he could not follow. He was also unsure whether to include a family property jointly held with a sibling.

THE APPROACH

The initial consultation clarified the scope and explained what a will could and could not cover in relation to jointly held property. A first draft was prepared in plain language. The client asked for one adjustment at the review meeting. The will was executed at a second appointment.

THE OUTCOME

A valid, clearly written will in place within six weeks of the first meeting. The client retained two copies and the joint property question was noted in supporting instructions for clarity. Fee: RM 700 as stated.

CASE-002 / PROBATE FILING

An executor in Cyberjaya, straightforward estate

THE SITUATION

The client had been named executor in her father's will but was unfamiliar with the probate process. She had gathered some documentation but was uncertain what else was required and how long the process would take.

THE APPROACH

A documentation checklist was provided at the first meeting. The probate application was drafted and filed at the High Court. Updates were provided when the application had been received, when a hearing date was set, and when the grant was issued.

THE OUTCOME

Grant of probate issued approximately eight months from the date of filing. The executor understood the timeline from the outset and found the wait manageable because she knew what to expect. Fee: RM 1,200 as stated.

CASE-003 / LIVING DOCUMENT SET

A couple in Presint 4, planning ahead

THE SITUATION

A couple in their late fifties wanted to put a full set of living documents in place after a family friend had been unable to manage a parent's affairs due to a lack of documentation. They wanted to act before the need arose.

THE APPROACH

Two meetings were held — one to gather information and explain the options, and one to review the three documents prepared for each party. Each document was read through aloud at the review meeting. The scope of the power of attorney was adjusted at the second meeting based on the clients' preferences.

THE OUTCOME

Each person left with a power of attorney, living will, and beneficiary instructions — six documents in total — drafted as coordinated pairs. All properly executed. Fee: RM 1,600 per person as stated; both matters were separate engagements.
